The immigration attorneys at Pozo Goldstein & Miranda have the experience to represent clients at the appellate level at the Board of Immigration Appeals and before Federal District Courts and Circuit Courts of Appeal throughout the United States. The first level of appeal is accomplished by filing a notice of appeal, Form EOIR-26 to the Board of Immigration Appeals in Falls Church, Virginia. The Board then issues a briefing schedule and both parties submit written briefs in support of their position. There is, very rarely, oral argument before the Board. It is very important to create a proper record of all appeal-able issues before the Board so they are preserved for the next appellate level.
The next appellate level is filing a Petition for Review before the appropriate Circuit Court of Appeal depending on the jurisdiction of the underlying case. This is a complex appellate process and can result in the attorneys being summoned to present oral arguments before a panel of three Appeals Court Judges. The attorneys at Pozo Goldstein & Miranda have appeared before the Eleventh Circuit Court of Appeal to orally argue cases. The Federal District Court hears cases involving Writs of Mandamus, Habeas Corpus, Civil Rights violations and emergency injunctive relief, etc. For example, when a citizenship case is languishing at USCIS without decision, an action called a Writ of Mandamus can be filed with the Federal District Court and a Federal Judge will hear the case and make a ruling ordering USCIS to move the case forward. These cases are filed as a last resort after all administrative efforts have been made to obtain a decision.
