Victory today for a 39 year old gay man from Venezuela who came to the US in 2002 on a visa and overstayed.
After living in the US for nine years illegally and without lawful status he was granted asylum based on the abuse he sustained as an outwardly gay man from the time he was a young boy until adulthood. We were able to prove through documentation and affidavits of experts in the field that the peril of being openly gay in a dangerously homophobic and violent country, our client’s life would be in danger if he were to return to Venezuela.
We were able to overcome the one year bar to asylum based on post traumatic stress disorder. He was granted political asylum at the Miami asylum unit after only one interview.
